Raskob, who helped oversee Essen's transformation through a mix of so-called Blue Green solutions: "Blue" for
water-focused initiatives, and "Green" for land-based projects. This two-pronged approach helped catapult Essen
to be declared the European Green Capital for 2017.
Essen's most high-profile project is the transformation of the Zollverein industrial complex – once the
world's largest coal and coke production facility – from toxin-spewing industrial blackspot to an inspiring eco-park
granted Unesco World Heritage status. Inside its giant former coal washing building, the impressive Ruhr Museum
enthrals visitors with displays on the site's history and transformation between towering old machinery. A short walk
away, the Red Dot Design Museum showcases examples of innovative global design in a former boiler house
building repurposed by renowned architect Norman Foster. Ever since mining at Zollverein and the surrounding
region ended in the late 1980s, woodland has spread across the vast site, and its trail-laced expanses are now
home to more than 800 animal and plant species.
Yet, Essen isn't resting on its green laurels and is continuing to add eco-friendly initiatives. A 100km cycling
'super-highway’ is slowly taking shape atop old industrial railways. A string of nature-walking trails have also been
created in and around the city to help boost local engagement with – and appreciation of – natural habitats. All the
trails are easily accessible by public transport.
Among the city's many transformations are the creation of lakes and ponds by harvesting rainwater. But
perhaps the toughest of Essen's solutions involved restoring the River Emscher, considered a biologically dead
"open sewer" since the end of the 19th Century, thanks to the dumping of mining and factory slurry and waste
water. After a two-decade clean-up programme, trout once again returned to the rejuvenated river in 2015. A recent
count found more than 1,000 fish and animal species living along the Emscher, including previously endangered
lapwings, kingfishers and beavers.
Though humans aren't yet encouraged to join the trout in the Emscher, an arena for swimming and boating
hums with activity at Lake Baldeney, a broad expanse of water created behind a 9m dam on the similarly cleanedup Ruhr river. When swimmers splashed here back in 2017, it was the first time bathing had been officially allowed
there for 46 years.
From German eyesore to proud green city, Essen's green-and-blue approach isn't just benefitting outdoor
enthusiasts and the environment but is also providing a shining example of how other cities can look to their

oferecem ao mercado preciosos documentos
públicos. Enquanto atuaram em funções estatais,
personagens como Epitácio Pessoa, José de Alencar,
Machado de Assis ou Pedro 2º produziram
documentos públicos que, hoje, são disputados como
investimento, como raridade colecionável e até como
instrumento de crimes financeiros. A depender do
conteúdo, do autógrafo, do estado de conservação e
da procedência, um documento pode alcançar
milhares de reais.
Papéis tramitados entre duas esferas
públicas, contudo, estão sujeitos, caso autênticos, ao
art. 10 da Lei nº 8.159/1991, que proíbe a
comercialização de documentos de valor histórico
egressos de arquivos públicos.
A Instrução Normativa 01/2007 do Iphan
(Instituto do Patrimônio Histórico e Artístico Nacional)
exige que leilões contendo documentos produzidos
até o ano de 2000 sejam previamente informados ao
órgão para análise de restrições de circulação ou
identificação de eventual interesse de alguma
instituição de acautelamento de patrimônio cultural.
A partir dessa informação, a autoridade pode
exigir a retirada do documento do leilão
definitivamente ou, caso seja necessário, para a
realização de perícia, a fim de identificar, por
exemplo, numerações, carimbos, vestígios de
amarração, marcas de que o papel foi destacado de
alguma encadernação, além do próprio conteúdo
oficial do documento. Tudo isso para definir
autenticidade e procedência do documento, mas nem

grande plataforma de leilão on-line como eBay,
Catawiki, Mercado Livre ou LeilõesBR, ou a grupos
de WhatsApp, Facebook e Telegram, provavelmente
saiu de modo ilícito de algum arquivo federal ou
estadual. O aperfeiçoamento da legislação esparsa e
a adoção de medidas interinstitucionais são um
caminho urgente e necessário para salvaguardar o
patrimônio documental.
Neste momento, a Câmara dos Deputados
discute o Projeto de Lei nº 2.789/2021, que atualiza a
Lei de Arquivos (Lei nº 8.159/1991) e torna
improbidade administrativa o ato de "agir ou concorrer
para a perda, desvio, apropriação, malbaratamento
ou dilapidação dos bens materiais e imateriais do
patrimônio histórico, artístico e cultural brasileiro,
inclusive mediante desestruturação e corte de verbas
para custeio dos órgãos incumbidos de proteger tal
acervo".
A proposta é bem-vinda. Não é razoável que
a Lei de Improbidade (Lei nº 8.429/1992) ainda não
contenha uma única referência a bens culturais. Mas
essa medida ainda demoraria algum tempo até
produzir efeitos concretos em uma realidade que,
neste momento, já exige providências urgentes.
Uma ação complementar, de efeitos mais
rápidos, poderia mobilizar os ministérios da Cultura e
da Justiça e o Ministério Público para obrigar os
marketplaces a se comprometer com "effective
moderation policies" e impedir a venda de bens
culturais sem prova de origem e comercialização
lícitas. Medidas auxiliares incluiriam a adoção de
códigos de conduta para essas plataformas digitais e
o desenvolvimento de "bots" para detectar
automaticamente, a partir da análise de imagens ou
palavras-chave via inteligência artificial, bens
procurados.
A Constituição Federal definiu os documentos
como parte do patrimônio cultural do Brasil (art. 216,
inc. IV) e fixou que é competência comum de todos os
entes da Federação protegê-los (art. 23, inc. III). A
Unesco, por sua vez, ao aprovar a "Declaração
Universal sobre Arquivos", em 2011, destacou o
"papel essencial dos arquivos para (...) assegurar a
memória individual e coletiva, e para compreender o
passado, documentar o presente com vista a orientar
o futuro".
Documentos – textuais, cartográficos,
iconográficos, fonográficos etc. – são preciosas fontes
de informação, e subtraí-los, extraviá-los, danificar ou
destruir é pôr em risco a nossa memória. Sem
memória, é impossível haver cultura e, sem cultura,
nada resta da sociedade. Descuidar do patrimônio
arquivístico, portanto, é o mesmo que abandonar uma
